Terms of Use

By downloading or using the Peakness app ("App"), you agree to these Terms of Use. If you do not agree, do not use the App.

1. The Service

Peakness is a fitness planning application that helps you create, log, and track workout sessions. Workout plans are produced automatically from the preferences and goals you provide. They are suggestions, not a prescription, and are not reviewed by a human before you see them.

2. Eligibility

You must be at least 13 years old to use the App. By using the App you confirm that you meet this requirement.

3. Your Account

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at im@peakness.app if you suspect unauthorised access.

4. Subscriptions and Billing

Peakness offers an optional paid subscription ("PRO"), which unlocks workout generation and related features. Subscriptions are sold as auto-renewing purchases through the Apple App Store or Google Play.

• Payment is charged to your App Store or Google Play account at confirmation of purchase.
• A subscription renews automatically at the end of each period unless you cancel at least 24 hours before the period ends.
• Where a free trial is offered, any unused portion is forfeited if you purchase a subscription during the trial.
• You manage and cancel subscriptions in your App Store or Google Play account settings. We cannot cancel a store subscription on your behalf, and deleting your account does not cancel it.
• Refunds are handled by Apple or Google under their own policies, not by us.
• Prices are shown in the App before purchase and may change; any change applies only to future periods.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse-engineer, copy, or redistribute the App or its content.
• Interfere with or disrupt the App or its underlying infrastructure.
• Use the App in any way that could harm others.

6. Health and Safety

Exercise carries inherent risks. You are solely responsible for assessing whether any workout plan is appropriate for your fitness level and health status. We are not liable for any injury, illness, or other harm that may result from following content in the App.

7. No Medical Advice

Nothing in the App constitutes medical, clinical, or professional fitness advice. Always consult a qualified professional before beginning a new exercise programme.

8. Intellectual Property

All content, design, and software in the App are owned by or licensed to us. You may not copy, reproduce, or distribute any part of the App without our prior written consent.

9. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that workout plans will produce specific fitness results.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to personal injury, data loss, or loss of revenue.

11. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms. You may stop using the App at any time and delete your account from within the App, under Settings → Privacy. Deleting your account does not cancel an active store subscription — cancel that in your App Store or Google Play settings.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law provisions.
